How HRA exemption is calculated

Under Section 10(13A) of the Income Tax Act, your exempt HRA is the least of these three amounts:

  1. The actual HRA received from your employer.
  2. Rent paid minus 10% of (Basic + DA). If this works out negative, it is treated as zero.
  3. 50% of (Basic + DA) if you live in a metro city (Delhi, Mumbai, Kolkata or Chennai), or 40% of (Basic + DA) if you live anywhere else.

Whichever of the three is smallest becomes your tax-exempt HRA; the rest of the HRA you received is added to your taxable salary. Only the basic pay and dearness allowance that forms part of retirement benefits count as “salary” here — other allowances are ignored. Note that the HRA exemption is available only under the old tax regime; if you opt for the new regime, you cannot claim it.

How is HRA exemption calculated?

Which cities count as metro for HRA?
For HRA purposes only Delhi, Mumbai, Kolkata and Chennai are treated as metro cities, where the limit is 50 percent of basic plus DA. Every other city, including Bengaluru, Hyderabad and Pune, is non-metro with a 40 percent limit.
Can I claim HRA exemption under the new tax regime?
No. The HRA exemption under Section 10(13A) is available only if you choose the old tax regime. Under the new regime this exemption is not allowed, so the full HRA you receive becomes taxable.
What if my HRA is more than my rent?
If you pay little or no rent, the rent minus 10 percent of salary figure becomes small or zero, so your exemption is limited and most of the HRA stays taxable. You can only claim exemption against rent you actually pay.
